In this article, the focus is on developing a governance concept built on integrating the ISO 26000 Social Responsibility standard with an “employee social responsibility” concept developed by the authors. To this end. The authors propose to compliment the voluntary, organizationally adaptable, ISO 26000 SR standard for the organization/firm with a seamlessly integrated—and equally adaptable—ESR concept for the individual/employee of that organization/firm. An SR/ESR governance concept emerges, with an emphasis on implementing a SR-based business enterprise code of conduct and ESR-related (...) functional-level codes of conduct, the latter firmly ensconced in an organization's ethical climate. The Dodd‐Frank Wall Street Reform and Consumer Protection Act, signed into law by President Obama in July 2010, included two significant corporate governance mandates: “say‐on‐pay” shareholder voting and the frequency of such votes among all publicly traded companies. The say‐on‐pay rule requires publicly traded companies subject to proxy rules to offer their shareholders an advisory, or nonbinding, vote at least once every three years on the compensation packages of the most highly compensated executives. The actual data for the first five (...) years of say‐on‐pay voting indicates one intractable conclusion: that shareholder say‐on‐pay voting has not verified what many shareholder activists originally believed, i.e., that the majority of shareholders held similar opinions about business executives being significantly overpaid for their managerial performances. During its first five years in effect, the results of say‐on‐pay voting indicate that shareholders are overwhelmingly satisfied with executive compensation packages, as a 92 percent average shareholder say‐on‐pay approval result (i.e., exceeding 70 percent) among companies listed in the Russell 3000 Index attests. RegelskiWhile I am appreciative of Roger Mantie’s generous compliments about my past scholarship, his review is often misleading and philosophically misinformed. In particular, what he refers to as my “editorialized, (...) overview of the history of aesthetics,”1 I clearly describe as a critical philosophy2 of the aesthetic theory of art according to recent philosophy of art.3Kantian aesthetic theory was not a theory of art.... It is primarily a theory of free beauty and of the sublime, of our responses to flowers and cascades and the starry sky at night.... [I]t is hotly disputed and probably false.... [T]he theory hardly suffices to characterize art in general, for the obvious reason that art as we know it is not divorced from the rest of society.4Therefore distinguishing between an aesthetic rationale for justifying school music and a philosophy of music education is vitally important. [End Page 99]The legitimation crisis facing music education in today’s schools (viz., declining schedules and resources) is one result of taken-for-granted belief by many teachers of music’s automatic aesthetic benefits as their supposition for advocating its inclusion in schooling. Such a tacit belief assumes, with Kant, that “being in an aesthetic state is as easy as rolling off a log, and, furthermore, it is available to everyone.”5 It supposedly occurs spontaneously in the presence of so-called “aesthetic properties.” According to analytic aesthetics, these properties qualify the “autonomania”6 (spelled incorrectly in the review) of music’s “for its own sake” value, and its “sacralization” (also misspelled) as a spiritual source of veneration. Unfortunately, the autonomy of school music from music’s social roots and role, under the aegis of an aesthetic paradigm, drastically limits its contribution to the general education of all students.Moreover, my position on what music “is” and “is good for” does not represent the “is/ought fallacy,” as Mantie mistakenly asserts.7 That fallacy in ethics depends on an unwarranted deduction from “is” (fact, description) to “ought” (value, norm)8 which is not at stake in my discussion. A Finnish child came home upset that he had left his “notes” on the tram. In English, he probably would have bemoaned leaving his “music” behind. Teachers who are content to stress mainly notation can miss “the music” (for example, what is meant when judging a performance to be unmusical). The “ersatz Kantian theory of art”9 postulates that art and music are created to evoke the aesthetic responses the theory hypothesizes (according to an aesthetic attitude, disinterestedness, free beauty, and many other putative criteria). When, instead, viewing music’s origins and purposes (for example, as in anthropology and ethnomusicology) as always social in meaning, consequences, and worth, then teaching that stresses music’s sociality (not its autonomy) is promoted and becomes a warranted curricular goal.Moreover, the aesthetic experiences postulated by aesthetic theory are covert, thus lacking empirical evidence of teaching or learning effectiveness, or for curricular planning! Their effects are just presumed. In praxis-based teaching, instead, results are amply observable to learners (thus motivating), to administrators (thus promoting curricular support), and to parents (thus for taxpayers). This is all the more the case when musicing is chosen as “worthwhile” (that is, literally, “good time”) after school and graduation: the ongoing disposition to engage in musicing is thus my praxial definition of music appreciation. All this is argued in my book, but is neglected in the review, except where, in minimizing the effects of the resulting legitimation crisis facing music educators, Mantie concedes that school music has “almost always been contested and fragile”10—as though it has not progressively suffered from recent trends (No Child Left Behind Act in the US, common core, testing mania, and so on). Since the onset of the latest United States (U.S.) recession (beginning in December 2007), the U.S. economy has been posting high unemployment levels consistently exceeding 8 percent. Of specific interest, the U.S. Department of Labor, Bureau of Labor Statistics (BLS), reports on a specific subset of the U.S. unemployed: the long‐term unemployed, defined as those who are unemployed for 27 weeks and over. Since December 2009, the share of the long‐term unemployed of the total U.S. unemployed has exceeded 40 percent (...) (through April 2012), the highest level since 1948 when data was first collected. A phenomenon of this recession is an alleged public bias by American private sector employers against hiring the long‐term unemployed, or even simply those unemployed. While the authors support the removal of discrimination against the unemployed in job advertisements, they cannot support the larger notion of including those who are unemployed as a protected class of employees. Becoming or being unemployed is a state that one can change, and based on the lack of research on how widespread this discrimination is (beyond anecdotal stories or limited research surveys), they believe that extending protection under equal employment opportunity legislation would be overreaching and inappropriate at this time. In February 2019, the German federal government announced its new “National Industry Strategy 2030.” Many economies—including the United Kingdom (2017), European Union (2017), and Saudi Arabia (2018)—have announced national industrial strategies addressing the competitive threat of the People’s Republic of China’s 2015 “Made in China 2025” 5-year economic plan to become a global leader in 10 advanced technology manufacturing sectors. The use of the 20th-century term “industrial policy” heralds back to public policy antecedents of what is now evolving globally in (...) the 21st century as national “industrial strategy,” a concept explored in this article. Unlike traditional 20th-century efforts at industrial policy (which focused on public policy efforts to maintain domestic primacy of declining, older industries), national industrial strategy recognizes (and generally accepts) the international global economy as a foundation of competition. Most importantly, national industrial strategy focuses on technologically emerging industries as well as the national government working collaborative in a partnership with these emerging industries to meet future growth challenges and opportunities. The chair of the ethics committee of a major medical center agonized over how he, as a physician, and his organization should deal with Initiative 119, which, if passed, would legalize physician involvement in active, voluntary euthanasia in Washington State. In the end, he said, he could not vote for aid-in-dying because, “However much I want to reduce suffering, I myself just couldn’t do it to one of my patients.” He spoke of a personal distaste for the potential act, of (...) a profound desire not to have to do it. It was not an ethical argument, but an honest and compelling expression of feelings.Why can’t this sincere man do it, even for patients who request such aid? In a 1991 poll, taken in Washington State prior to the vote on Initiative 119, 49 percent of the physicians surveyed supported the initiative, but 75 percent did not want to participate in aid-in-dying. Jean-Luc Marion is one of the world’s foremost philosophers of religion as well as one of the leading Catholic thinkers of modern times. In _God Without Being_, Marion challenges a fundamental premise of traditional philosophy, theology, and metaphysics: that God, before all else, must be. Taking a characteristically postmodern stance and engaging in passionate dialogue with Heidegger, he locates a “God without Being” in the realm of _agape_, or Christian charity and love. In a classic article, philosopher William P. Alston argues that nonrealism, “though rampant nowadays even among Christian theologians,” is “subversive” of theistic faith.1 Among contemporaries guilty of succumbing to this philosophical bogey, Gordon Kaufman is singled out as an especially illuminating example. Alston notes that in the essays that make up God the Problem, Kaufman makes use of a distinction between the “available referent” of theistic language and its “real referent,” the former indicating the actual object of religious experience and (...) responses, and the latter appearing only as the “I-know-not-what” that ultimately grounds them. The dissertation explores the philosophical, literary, and stylistic similarities between the twentieth century American writer Sherwood Anderson and the nineteenth century Danish philosopher Soren Kierkegaard. These similarities suggest that the Ohio writer's work and aesthetic were deeply influenced by the Danish thinker, and the connection between them lies in the immigrant rural religious communities of the American Middle West. Ultimately, these interrelations reveal a "religious-aesthetic" unique to the entire range of Midwestern literature of the late-nineteenth and early-twentieth centuries, and they (...) also reveal a politics and an aesthetic of Midwestern art available yet today. This paper addresses the importance of words and of surrendering words, and so will consider both the philosophical and axiological potential of ineffability, both of which imply epistemic humility. On the one hand, epistemic humility implicates surrendering ill-fitting and limited constructs; this reflects a project of unknowing, a condition for a more authentic knowing, driven less by rigid categories and argument and more by humility and love. On the other hand, epistemic humility—as an observable phenomenon in the world’s religious traditions—has (...) axiological value and thus should be cultivated: it subverts an arrogant knowing which too often is the seed of destructive conflict. To be a player in the international standards-setting arena of network industries, such as those dealing with information technology, reaching an early domestic consensus for a critical interoperable technology design is often essential. While in most cases efficient outcomes emerge through the market-driven, U.S. technology standards system, there have been situations where a timely consensus has failed to be attained with negative consequences for the international competitiveness of the U.S. economy (e.g., second generation of cellular telephony). An anticipatory policy approach, (...) based on a standards competition which takes into consideration antitrust and intellectual property rights, is proposed as a solution. (shrink)

This essay consists of (a) an exploration of the relation between Aquinas and Heidegger as this is discussed in the work of John Caputo, and (b) an attempt, in the light of what is learned from the previous discussion, to rethink the essence of Thomistic metaphysics in a way that is both faithful to the spirit of Thomism, remaining attentive to its mystical source, and alive to the mystery of Being in a Heideggerian sense. In this way the argumental structure (...) central to that metaphysics is treated as a Wittgensteinian ladder that we can kick away, that is, which auto-deconstructs, thereby placing us before unlimited, unqualified existence, the Difference between existence and nothingness. Among the oldest extant medical ethics, the Hippocratic Oath prohibits the giving of a deadly drug, regarding this act as an egregious violation of a medical ethic that is exclusively therapeutic. Proportionate palliative sedation involves the administration of a deadly drug. Hence it seems to violate the venerable Hippocratic promise associated with the dawn of Western medicine not to give a deadly drug. Relying on distinctions commonly employed in the analysis and evaluation of human actions, this article distinguishes physician-assisted suicide (...) and euthanasia, as acts that necessarily violate the prohibition against giving a deadly drug, from proportionate palliative sedation, as an act that does not. Most discussions of the potential of new information technologies (IT) for education have taken one of two forms: enthusiastic proclamations of the revolutionary impact that IT can have for teaching and learning in school and nonschool settings, or dire warnings of the terrible fraud being perpetrated on society about the educational potential of IT. This essay attempts to avoid exaggerated optimism and pessimism about IT and education, while avoiding the trite oversimplification that technology is “neutral” and can be used for (...) good or bad purposes. Our view is guided by the assumption that it is actually very difficult, if not impossible, in many cases to sort out benefits from costs—the very same outcomes can be viewed as favorable or unfavorable, depending on other assumptions about their effects. We propose a posttechnocratic view of IT that recognizes the multiplicity of effects, the indeterminacy and inseparability of consequences, and the difficulty of isolating “good” and “bad” outcomes. As an example of posttechnocratic analysis, the recent educational concern about censorship and the Internet is discussed to demonstrate how educational policy choices are often more complex and ambiguous than we might wish. In this article, we address the public issue of mandatory Genetically Modified Organism (GMO) retail food labeling in the U.S., first by reviewing the policy arguments both in support and against labeling food containing GMOs; second, by describing the existing U.S. federal regulatory system pertaining to GMO labeling, and why it does not presently require labeling of food containing GMOs; third, by reviewing and interpreting the results of studies of American consumer attitudes toward mandatory GMO retail food labeling; fourth, by (...) evaluating, through the utilization of issue life cycle analysis in the nonmarket environment, where the issue of GMO retail food labeling stands in the national public policy process; fifth, summarizing the state of scientific evidence addressing the safety of GMO foods and the existing regulatory and public policy environment for this issue; and sixth, offering legislative and litigation strategies for the mainstream food nonmarket strategy framework to formally assess the GMO industry to protect their interests and those of American consumers not concerned with GMO food ingredients, while offering a voluntary labeling strategy for firms responding to and recognizing the “rights” of American consumers who “choose” to purchase non‐GMO food products.
